Sir,
I received your letter of 2/20/06 (postmarked 3/1/2006), and it is not satisfactory.
Debris can cause water to back up, but when you were here you clearly pointed out failures in the caulking in the side of the chimney, where debris does not accumulate. The current leak at the chimney also occurs with no debris at the chimney. You also pointed out cracks and holes in the shingles in other parts of the roof due to shingle failure, unrelated to any debris accumulation.
At the time of installation, it was never mentioned that we would need to purchase maintenance of any type. We were repeatedly extolled the virtues of your warranty that if we ever had any problems, we had but to call. You are responsible for those assurances.
I have been advised by my attorney to obtain an estimate from another company for repairs for the leak, repairs for the damage to the interior of the home, the cost for them to warranty the roof for the remainder of the warranty period, and other appropriate costs.
I expect you to repair the issues with my roof by March 17, 2006 as covered by the warranty. Should the repairs on the roof not be completed by that time, I will pursue your financial responsibility in court.
